The FBI busied itself planning such detentions even before Congress passed the enabling legislation. On June 27, 1950, acting under a 1949 Emergency Detention Plan agreed upon with Secretary of Defense Forrestal and Attorney General Clark (before Congressional authorization), and in light of the Korean War, which had broken out only days before, the FBI office in Baltimore sent a letter to Hoover adding Abe and Julia to the list of individuals to be “apprehended or detained” and to have their apartment searched and “contraband” confiscated.
